These Terms of Service & Sale ("Terms") apply to your use of polacat.com and purchases from the PolaCat online store. By browsing the store, submitting an order, or using its services, you agree to these Terms. If you do not agree, do not use the store or place an order. Questions may be sent to orders@polacat.com.
1. Guest checkout and customer information
No customer account is required. You must be legally capable of entering into a purchase contract and provide accurate, current billing, shipping, and contact information. You are responsible for reviewing the email address, delivery address, products, quantities, and total before payment. Contact us promptly if an order confirmation contains an error.
2. Products and descriptions
We make reasonable efforts to describe products accurately. Screen colors, packaging, and minor production details may vary. Vintage and restored cameras may show age, wear, replaced parts, or cosmetic differences; the individual listing, photographs, condition grade, and test notes form part of the product description. Compatibility statements are based on information reasonably available to us, but you should confirm the required film, battery, accessories, and regional specifications before ordering.
Film and instant film are light-, heat-, and age-sensitive consumables. Results can vary with storage, transport, camera condition, and shooting environment. Any expiry date or storage condition shown on the product page forms part of the description.
3. Prices, currency, taxes, and import charges
Prices are displayed in the currency shown at checkout. The checkout total will show product price, discounts, shipping, and any taxes collected by us. Your card issuer or PayPal may apply currency-conversion or other fees. For international shipments, the recipient is responsible for import duties, taxes, brokerage, and customs charges unless checkout expressly states that they are included. We may correct an obvious pricing or calculation error before accepting an order and will offer cancellation and a full refund if you do not accept the corrected price.
4. Orders and contract formation
Submitting an order is an offer to buy. An automated order email confirms receipt, not necessarily acceptance. We accept the order when payment is successfully confirmed and we send an acceptance or dispatch notice. We may reject or cancel an order before dispatch because of stock errors, suspected fraud, payment failure, shipping restrictions, sanctions or export controls, an obvious pricing error, or inability to fulfill. If payment has been captured for a cancelled order, we will refund it to the original payment method.
5. PayPal payments
Payments are processed by PayPal under PayPal's applicable user agreement and privacy statement. By choosing PayPal, you authorize the displayed amount and information needed to complete the transaction. PolaCat does not store your PayPal password or full card number. A PayPal authorization or pending transaction is not proof that we have accepted the order. Please contact us first about an order problem; nothing in these Terms limits rights you may have through PayPal or applicable law.
6. Coupons and promotions
Coupons must be entered before checkout and are subject to their stated dates, eligible products, minimum spend, region, and usage limits. Unless expressly stated, coupons cannot be combined, exchanged for cash, applied after purchase, used for shipping or taxes, transferred, or resold. We may refuse or cancel coupon use involving error, manipulation, unauthorized publication, or fraud. If a return causes the remaining order to fall below a promotion threshold, the refund may be recalculated to reflect the valid discount.
7. Shipping and delivery
Our Shipping & Returns Policy is incorporated into these Terms. Delivery dates are estimates unless we expressly guarantee a date. You are responsible for providing a complete deliverable address and for responding to carrier or customs requests. Contact us promptly if tracking is delayed, a parcel is lost, or an address needs correction. Ownership and risk pass as required by applicable consumer law; these Terms do not shift a risk that the law requires us to bear.
8. Cancellations, returns, and refunds
Contact orders@polacat.com as soon as possible if you wish to cancel. We cannot guarantee cancellation after packing or dispatch. Return eligibility, condition requirements, instructions, and shipping responsibility are described in the Shipping & Returns Policy and the product listing. Do not send a return without authorization and the correct return address. Approved refunds are sent to the original payment method; bank or PayPal processing time is outside our control. Nothing in these Terms excludes a mandatory cancellation, return, refund, or warranty right.
9. Damaged, incorrect, or missing goods
Inspect the parcel promptly. If an item is damaged in transit, incorrect, or missing, contact us preferably within seven days of delivery with the order number, packaging photographs, product photographs, and a description. Keep the packaging while we investigate. This notice period helps carrier claims and does not remove rights that cannot legally be limited or a claim for a defect that could not reasonably be discovered earlier.
10. Product warranties
New products receive any warranty stated in the listing or provided by the manufacturer. Vintage or restored products are covered by the specific tested functions and condition stated in their listing, together with any mandatory statutory warranty. Normal cosmetic wear that was disclosed, consumable film results, accidental damage, misuse, improper storage, unauthorized repair, and incompatible accessories are not defects unless applicable law provides otherwise.
11. Acceptable use
You may not misuse the site, interfere with security or operation, attempt unauthorized access, submit false payment or delivery information, scrape the store in a way that burdens the service, infringe intellectual property, or use the store for unlawful, fraudulent, export-restricted, or sanctioned transactions. We may block activity or cancel orders reasonably associated with such conduct.
12. Intellectual property
The PolaCat name, site design, original text, graphics, and other store content are owned by or licensed to PolaCat and may not be copied, republished, or commercially exploited without permission. Product and manufacturer names and marks belong to their respective owners and are used only to identify compatibility or the goods offered.
13. Availability and liability
We do not promise that the site will always be uninterrupted or error-free, but we will use reasonable care in operating it. To the fullest extent permitted by law, PolaCat is not liable for indirect or consequential loss that was not reasonably foreseeable, and our aggregate liability relating to an order will not exceed the amount paid for that order. These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any liability or consumer right that cannot legally be limited.
14. Events outside reasonable control
We are not responsible for delay or failure caused by events outside reasonable control, including severe weather, disaster, war, epidemic, strike, carrier or customs disruption, government action, power or network failure, or supplier interruption. We will take reasonable steps to reduce the effect and inform affected customers when practicable. Your mandatory rights remain unchanged.
15. Privacy and electronic notices
Our Privacy Policy explains how we handle personal information. You agree that order receipts, payment updates, shipping notices, policy notices, and customer-service replies may be delivered electronically to the email address supplied at checkout.
16. Governing law and disputes
These Terms are governed by the laws applicable to the seller's establishment and the transaction, without depriving you of mandatory consumer protections or a forum available under the law where you live. Please contact us first so we can try to resolve a dispute informally. You may also use any consumer-protection authority, court, or alternative dispute process available under applicable law.
17. Changes, severability, and language
We may update these Terms prospectively by posting a revised version and effective date. The Terms in effect when an order is accepted govern that order unless a change is required by law or agreed with you. If one provision is unenforceable, the remaining provisions continue to apply. Our failure to enforce a provision is not a waiver.
These Terms are available in English, Simplified Chinese, Traditional Chinese, and Japanese. If translations differ, the English version controls to the extent permitted by applicable law.
